On October 31, a congressional candidate orders a quantity ofcampaign literature from a local printer. The verbally stated timeof performance is November 2. November 8 is Election Day. Theliterature is not delivered until November 9. The candidate refusesto pay the printer. Nothing was said in the contract about timebeing of the essence. The printer sues for breach of contract torecover the cost of the printing.
