Chapter 12 Case Study Completion Complete each statement, Barbara is a 37 year old woman who is pregnant and in her 20 week. She is married and has one child, a 4 year old girl named Lilly. At the advice of her obstetrician, Barbara has received genenic counselling and undergone amniocentesis, so that tests can be performed for chromosomal abnormalities and neural tube defects. When the tests come in, Barbara is told that the fetus has been diagnosed with a chromosomal abnormality known as Turner's syndrome. A normal female has two X chromosomes. In Turner's syndrome, one of the two X chromosomes is missing; there is a total of 45 chromosomes (not the usual 46). Females who have Turner's syndrome have a characteristic appearance of a short stature, webbing of the neck, sagging eyelids, low hairline on the back of the neck, and multiple moles. The syndrome is also characterized by narrowing of the aorta, the failure of menstruation and breast development, and infertility later in life. Although many patients with Turner's syndrome have difficulty performing tasks that require spatial orientation, they cannot otherwise function normally in society. With the Turner's syndrome diagnosis in mind Barbara's doctor advises her to undergo an abortion for the 20 week fetus.
3. Consider the following scenario: Because of the test results and her deteriorating health, Barbara has decided to get an abortion, despite her husband's disapproval. Legally could Barbara's husband do anything to (force) Barbara to keep the pregnant with the fetus who has Turner's syndrome? In the given scenario, let's suppose that Barbara's doctor was against the potential prospect of abortion and that he did not come forth with the results of the amniocentesis. Because he knew that Barbara and her husband are poor and financially unstable, and that they would not be able to afford to provide the additional resources that may be required to raise a child with special needs. Barbara has come to the conclusion that keeping this child would have a devastating effect on her life. In your opinion, would the doctor's action make him liable for a wrongful birth suit? The withholding of this data plays a major factors in Barbara's decision to carry on with the pregnancy, so can you think of anything else Barbara's doctor would be negligent of if he withheld the diagnosis from the amniocentesis (please explain your reasoning)
