Mrs Yelp bought a
new type of air freshener for her car. It uses oil and the
instructions state that is should be used with the lid on. One day,
her son Sammy, finally got a date with the girl of his dreams and
asked to borrow the car. Mrs Yelp readily agreed, she went to the
petrol station to fill up the tank so that Sammy could drive the
girl as long and as far as he wished. She went home and passed the
keys to Sammy.
When Sammy got into
the car, he removed the lid from the air freshener as he thought
that would make the car smell nicer to impress the girl. As soon as
he switched on the car ignition, the interior of the car exploded
and ignited into flames. Sammy’s clothes and arms caught fire.
Sammy quickly jumped out of the car screaming in pain and rolled
around on the concrete ground in an attempt to put out the fire
that was engulfing him. Both Mr and Mrs Yelp heard Sammy’s screams
but only Mr Yelp saw what happened to Sammy and he told his wife
that Sammy was on fire. Mrs Yelp screamed and fainted.
Mr Yelp managed to
put out the fire on Sammy and inside the car with the garden hose.
Sammy’s arms were very badly burnt and he ended up having to spend
months in the hospital recuperating and undergoing extensive skin
graft operations. Mrs Yelp was so badly traumatized by the entire
incident that she suffered from Post-Traumatic Stress Disorder
(PTSD) and had to undergo expensive psychiatric treatment.
Investigations
showed that the air freshener was part of a batch that contained
too much oil. The excessive oil vapor coupled with the flammable
vapor from a petrol station would have caused an explosion, but the
explosion would not have been as big if the lid had been screwed
on.
Required-Sammy wants
to sue Getting Fresh, the manufacturer of the air freshener. Advise
him on the issues of duty of care, breach of duty and resulting
