Kyrie is an unemployed electrical engineer who has taken up a
job as the manager of her friend Lilith's hair salon and business;
"Hair by Design or Fabrication". Lilith is an award-winning
hairstylist whose business also involves training stylists in her
techniques and promoting products (such as hairdryers, and
attachments) to improve styling. Lilith also endorses products
online in her own channel. Lilith's channel is a successful part of
her business.
Kyrie’s employment primarily involves organising stocks (such as
conditioner, toner, colours, hair extensions etc), making client
appointments, and doing the bank reconciliation statements of the
daily earnings. He supervises the efficient running of the business
including the channel, where Lilith demonstrates hair
techniques and products.
Kyrie becomes fascinated with how Lilith's uses a 'brush and
blow dryer' technique to smooth fly-aways. This skilled technique
involves the stylist using a round brush to section and manage the
hair, whilst directing airflow from the dryer to push the fly-aways
into the style and out of sight.
Kyrie researches this technique and finds it is known as the
"Coanda effect". The Coanda effect is a phenomenon in which a jet
flow attaches itself to a nearby surface and remains attached even
when the surface curves away from the initial jet flow
direction.
Kyrie becomes obsessed with finding a way to replicate this
method for the everyday home stylist to use. In the basement at her
home, she uses her engineering skills and equipment to develop a
hairdryer attachment that replicates the Coanda effect without the
need for using a physical brush. Her hairdryer attachment has the
added advantage that it smooths fly-aways out of sight, without
exposing the hair to extreme heat damage.
Kyrie develops drawings and a prototype hair dryer attachment
but needs to perfect the attachment for manufacture. She approaches
her friend and fellow engineer Brenda. Brenda is a Phd student, who
now works as a researcher investigating applications and uses of
jet airflow at Mona Institute of Technology (MIT) research
laboratories. Brenda is a junior researcher who works for senior
researchers and is assigned to research projects as they arise. She
also teaches classes in airflow dynamics to undergraduate students
at MIT. Brenda makes prototypes from Kyrie's drawings using MIT's
3D printer. Kyrie and Brenda discuss refinements to the hairdryer
attachment and further prototypes are made that are then tested by
Lilith in her salon under strict confidentiality agreements. Lilith
enjoys using the attachment as it stops her getting sore wrists
when curling the brushes to do the same effect with a brush. She
does not understand how the attachment manages to do what she has
done for 20 years using a brush.
Kyrie files a patent in her hairdryer attachment. She is now
commercialising the attachment and a number of manufacturers have
expressed interest, but Lilith, Brenda and MIT all believe they
have rights to ownership of the patent.
Explain to Kyrie whether;
(a) Lilith or Brenda can claim to be joint inventors with Kyrie,
or (400 words)
(b) MIT can claim to be owners;
of the patent under the provisions of the Patents Act 1990 (Cth)
