Alice is employed by Ace. At a conference, Alice meets
Joe, a chemical engineer employed by Brown (one of Ace's
competitors). After the conference, Alice and Joe agree to have a
drink at a bar. Alice does not hide the fact that she works for
Ace. Early in the conversation, Joe tells Alice that he is not
supposed to be talking to competitors’ employees at the conference.
After several drinks, Joe divulges secret information about Brown's
chemical process for making its products. Alice provides this
information to Ace and explains how she got it. Ace uses the
information in its own manufacturing process. Has Ace violated
Brown’s trade secret rights? Explain why or why not.
