Designated Substances
Under the Occupational Health and Safety Act, the Lieutenant
Governor has the power to prescribe a known toxic substance as a
“designated substance”. This gives the government the power to
“prohibit, regulate, restrict, limit or control its use, handling
and removal in regulated workplaces”. Where a toxic substance might
endanger worker health and safety, a Director from the Ministry of
Labour also has the power to issue an employer with an order of
compliance under Section 33.
Hazardous materials themselves are governed by Regulation
490/09, which lists specific chemical agents as “Designated
Substances” in the Application section. Worker control and exposure
is governed by Regulation 833 (1990), which sets occupational
exposure limits (OELs) for approximately 725 biological and
chemical agents. When required, additional regulations have been
enacted for specific situations like handling asbestos on
construction sites (Reg. 278/05). A further list appears below.
For this activity, you need to review these regulations and
learn how their structure works. The primary focus for this review
is Designated Substances Regulation 490/09. (You do NOT need to
report on the other documents directly.) Regulation 490/09 contains
sections for application, employer duties, assessment and control,
medical examination, and variance from a code. Equally important
are the various “schedules” for airborne measurement, emissions
controls, work practices, hygiene facilities, medical surveillance,
and respiratory equipment.
