2) then determine if the patient's has DMC and can/cannot make
an autonomous decision.
A 79-year old male with end-stage COPD is on 2L of continuous
oxygen. He lives alone in a high-rise senior living complex
(multi-floor building with many residents). Home health comes in to
replenish his oxygen tanks and ensure that care of the equipment is
being maintained. A 55-year old daughter comes in from out of town
every Sunday to visit, clean and bring groceries. Despite repeated
education from the general practitioner and home health regarding
the dangers of the presence of oxygen and smoking up to and
including explosion, the patient continues to smoke as evidenced by
the smell of the cigarettes, cloudiness in the air and cigarette
liter in the garbage. When interviewed the patient claims he has
stopped and has no recall of throwing the ashes away. Concerns have
been raised by neighbors and the health care team.
