Question 2 In constructing a building, Ir. Ali, a consulting engineer, was employed to develop a solar panel system that would partially replace their dependence on public-utility power system, which is subjected to power failures once a month. Ir. Ali who is a registered professional engineer with practicing certificate proposed to install solar panel on top of the building flat roof. However solar power panel needs maintenance work and electricity cannot be generated during maintenance period and for solving this problem he proposed to maintain power by installing a standby diesel generator, during maintenance, the generator would power the building. He presented the concept to the Municipal Council. Ir. Jamek a chemical engineer in Municipal council with no solar power supply experience, concluded that the design for the project was excessive and putting the taxpayers (including him) to unnecessary expense by installing the standby diesel generator. Ir. Jamek reasoned that the solar power supply would be more than adequate to take care of both the maintenance stoppage and the power supply failure, even if both occurred simultaneously. Without getting in contact with the engineer in charge for the project, he immediately reported to the municipal Council higher management, identifying himself as a "Professional Engineer" and criticizing what he called "unnecessary and expensive duplication. The report closed with a flippant comment questioning either the engineer for the project was performing work with honesty or competence. The municipal Council discussed the report and, since a qualified engineer wrote it, the Council concluded that it would be politically unwise to ignore it. The Council voted to ask Ir. Ali to respond in writing to Ir. Jamek allegations. Ir.Ali was surprised at this request from the Council, but felt obliged to honour it. He dropped all other tasks and summarized his calculations in a report, which he had printed and bound. He then returned to the municipal Council the following week and explained his reliability calculations, which confirmed the configuration that he was recommending. He explained that, while the report quoted "best-case" values, his calculations required "worst-case" probabilities. In addition, it was indeed statistically probable that the power failures would occur simultaneously. Moreover, the proposal included a contingency for
building expansion during the next 40 years. It soon became clear that his proposal was a very reasonable solution to the problem. Ir. Ali calculated his additional time and report preparation costs at about RM10,000. While he expected his design to undergo public scrutiny, he did not expect an uninformed attack from a fellow engineer. He knew that the Code of Ethics required public opinions to be founded upon "adequate knowledge and honest conviction," so he called the Board of Engineers Malaysia (BEM) to ask whether such thoughtless public criticism from Ir. Jamek unprofessional conduct was. BEM called Ir. Jamek to ask for clarification, but Ir. Jamek did not respond. However, at the end Ir. Ali decided that he had not suffered any loss of reputation, that he was too busy to make a formal complaint and declined to pursue the matter further. The case was closed without any action. a. Identify one (1) unethical behavior by Ir. Jamek and support the answer with a provision (complete with provision number and the content) from the related BEM Code of Conduct 001 which justify the act as 'unethical'. (4 marks) b.
