Patient James went into the hospital for a simple plastic
surgery procedure. At the time of admission patient James signed a
document, living will, stating that she did not want a blood
transfusion during the surgery except for her own blood which she
had donated prior to the surgery. During the time of surgery there
was a complication and all of patient James' donated blood was used
up and the physicians required another supply of blood to address
the complication and keep patient James alive. Following the
hospital admission patient James sued the Surgeon. What is the best
