The role of a mediator is to
facilitate two or more parties to come to a resolution of a
perceived problem. Many times, the mediator will allow
communications to flow where prior to her/his intervention, such
communication was non-existent or distorted because of the
emotional interplay of the parties. Another role of the mediator is
to point out the mutual advantages of reaching a decision. In some
cases, the advantages may not be the same to each party. For
example, an employee works 9 years and 8 months in a job as an
employment Interviewer. The employee has had a troubled history of
not getting along with her co-employees for the past three years.
She also has shown some bizarre behavior - she talks to herself;
she often makes no sense when she attempts to communicate with
management. Both the union and management come to the mediator to
resolve this situation. the mediator sends the employee for a
medical examination in which the physician diagnoses the employee
with schizophrenia with paranoia. He suggests that she is not able
to continue with her job duties and needs hospitalization. At this
point, management could terminate the employee's services without
much of problem. However, with ten years in the pension system the
employee becomes vested and is eligible for a disability retirement
pension. This type of pension would pay an annuity of 40% of her
average salary for the last three years, plus her full medical
coverage, plus 1 1/2 times her last salary in term life insurance.

really can not perform her duties, continue to work?
3. What if the employer decides to
allow the employee to work at home on miscellaneous material for
the four months necessary to qualify for the disability retirement
pension?

resolved to both parties' satisfaction, what is the obligation owed

2. Because the mediator is just a
facilitator, does s/he have the obligation to "blow the
whistle"?
