6. Examine the following employment contract and write an analysis clearly highlighting at least 9 points where local labour laws might have been violated. In order to be considered for training in a local organization, Emily was asked to sign a commitment not to get involved with any trade unions as long as she was employed by the organization. She was then issued with a contract for service which required her to work a minimum of 40 hours across several businesses owned by her employer. Her contract of employment required her to submit a monthly bill for the hours worked, though she was prohibited from working in excess of Op hours per week. Her contract stated that she would be paid an hourly rate of $12 per hour for all fours worked pending verification by the supervisor. The company does not pay for non-work days, but grants an opportunity to Emily to recover lost hours by working back the time. She is entitled to one hour unpaid lunch per day and any meal taken at the staff canteen would be deducted from her monthly pay, given that she is a contractor. Statutory deductions must be paid by Emily and her work tools would be purchased up-front by her employer but would be discounted from her pay over time; the amount would be credited to her once she worked out the life of her contract. Said tools would become the property of the employer once Emily left the employment. To ensure that Emily is properly identified whilst on the compound, she is issued the company's uniform but is prohibited from wearing same outside of work hours. Emily, a single mother of 3 children, accepts the terms of her contract but wants to know whether everything is legal. [9 marks]
