QUESTION 3 (25 MARKS) Ir Khalid is a Professional Engineer with Practicing Certificate (PEPC) who registered with BEM. He has been working with a University as a lecturer for many years in the field of mechanical engineering. One day, Ir Khalid is approached by his father's friend, Hasnan, who is an experienced clerk of work for structural and construction. Hasnan knows many people and has quite a good knowledge of how to secure a project. As Hasnan had no qualifications, he invited Ir Khalid to work with him to open a consulting firm, as shareholder where Ir Khalid would be appointed as one of the Directors and at the same time maintain his position in a government agency. As a lecturer, Ir Khalid was also encouraged to provide consultancy services as long as it did not interfere with his main job. His presence in the company is required only when needed. Hasnan proposal is indeed tempting. a. Should Ir Khalid accept the proposal? Why? b. Did Ir Khalid qualify to become a shareholder or director of the consulting firm? Explain in accordance with REA 1967 and RER 1990. c. When setting up the consultant firm, Hasnan has with him; one general clerk, two draftsmen and one runner. Is the consultant firm set up by Hannan subject to the Occupational Safety and Health Act 1994? Explain. d. At the same time, Hasnan also offered the same position to Ir Nik, who is a PECP in electrical engineering. If Ir Nik accepts the offer, what are Hasnan general duties as an employer?
