Question 2 Helen is an Engineer working with OTIM Engineering, and her main duty is to design a software programme for robotic vacuum cleaners, which are autonomous vehicles for cleaning the floor, including wet mopping. For example, Helen recently has successfully designed a software programme that enables a robotic vacuum cleaner to return to its base automatically when detecting insufficient onboard battery power. The function of automatic return is known as automatic homing, which will be soon released in a new series of products of OTIM Engineering. Since Helen is employed as a Senior R&D Engineer, Helen has signed her employment contract with OTIM Engineering, which confirms her duty of keeping confidential information & assign IP rights of her job to OTIM Engineering. Helen's brother Joel is an undergraduate student, and Joel is enthusiastic about civilian drone racing. Often, Joel joins drone racing games in Pulau Ubin, but Joel's drones go missing frequently due to his carelessness. Helen decides to help her brother by modifying the software programmes of Joel's drones, which are open source products. Particularly, Helen has utilised her knowledge and skill by implementing an automatic homing function for Joel's drones so that Joel's drones will always return to their base (i.e. Joel) when detecting insufficient power or signal loss. Both Helen and Joel know that nobody has even designed or implemented an automatic homing function for drones. (b) (c) (d) (e) Identify the IP rights involved in Helen's job with OTIM Engineering, and particularly Helen's assistance with Joel's drones. Provide justification. (9 marks) What are the legal criteria for protecting the identified IP rights in the above scenario? (6 marks) Who owns these IP rights? (5 marks) Illustrate how the IP rights in the above scenario can be protected locally and in overseas. (3 marks) Show how the owner of the IP rights in the above scenario can maximise the potential benefits from the IP rights. (2 marks)
