Susan decided to switch cell phone carriers because the service she received from Rogers was not reliable, and their customer service was even worse. She had only had the phone for two months and there was a further twenty two months remaining in the contract. When she cancelled her service she was told by Rogers that she owed them a cancellation fee and liquidated damages of $4,000.00, as this was clearly stated in her contract. In these circumstances the court would: reject the claim for this amount as the consideration provided by Rogers is inadequate enforce this payment as it was a clear term of the contract reject the claim as such a high amount would be seen as a penalty and not a reasonable estimate of actual damages flowing from a breach
