below.
a) state the relevant facts. Remember to quote/paraphrase (and
reference) an academic source for each case.
b) discuss if the elements of decision making capacity are
present?
c) evaluate if the patient's choice impacts others? (Autonomous
actions of a patient that infringe upon the rights, health, life or
welfare of others are morally questionable and should lead one to
question a patient's decision making capacity)
2) then determine if the patient's has DMC and can/cannot make
an autonomous decision.
A 79-year old male with end-stage COPD is on 2L of continuous
oxygen. He lives on a main road with significant traffic with his
80-year old wife and 50-year old autistic, non-verbal son. Home
health comes in to replenish the patient's oxygen tanks and ensure
that care of the equipment is being maintained. A 55-year old
daughter comes in from out of town every Sunday to visit, clean and
bring groceries. Despite repeated education from the general
practitioner and home health regarding the extreme dangers of the
presence of oxygen and smoking up to and including an explosion,
the patient and his wife continue to choose to smoke and remain in
the home. When they are questioned about their understanding of the
risks they are taking, their response is "it will be fine".
However, to complicate matters, the alarm on the oxygen machine
constantly goes off (due to the presence of smoke) which startles
the son and sends him fleeing. There have been more than one
incident where the son was almost hit by a car since their home is
on a busy road. Concern has been raised by the home health
providers that visit the patient.
