I bought a 12-year-old house 2 years ago with a latent defect in
it. I did not get a regular house inspection at the time of
purchase and did not check the roof space before buying the house,
but six months ago, I took a look in the roof space and noticed the
latent defect. On consulting with a roofing contractor, I was told
the defect would have been detectable at the time of puchase, but
probably not much before that. Which of the following statements is
most accurate regarding my time limits for pursuing the house
builder for the defect?
a. The time for pursuing the case has expired, unless the
builder attempted to hide the defect
b. The time for pursuing the case will run out in 18 months - 2
years after discovery
