Maria works for Royals Plumbing and HVAC company. Royals
Plumbing is a commercial business operating in two states with 100
employees. Of the 100 employees, there are 75 technicians.
Only 5 females are employed with Royals Plumbing as a technician.
Maria has been employed with the company for two years. She
began as an apprentice trainee and has worked her way to full time
licensed technician. For the first 18 months, her trainers
and managers were good. About 6 months ago, a new manager was
hired, and Maria began experiencing some challenging issues at
work. In the break room, more lurid posters were allowed on
the walls, with partially undressed persons. A score chart
for female employee attractiveness appeared next to the coffee
maker. Her manager would comment on her hair and the fit of
her uniform. The women’s restrooms became unisex restrooms,
but the men’s restroom remained for men only.
Maria loved her job and had worked diligently to acquire her
licensure. She was concerned that if she complained, she
would be fired, and no other company would hire a disagreeable
woman. However, the hostile and toxic work environment was causing
Maria to lose sleep, and she dread going into work. She
needed her job to provide for herself and family.
What are Maria’s options?
1. Identify and discuss
the legal issues in this scenario. Identify the federal laws.
2. What are some actions that
Maria can take to correct this situation? What facts may be
necessary to pursue these actions?
3. What is retaliation, and
is it a legitimate concern for Maria?
4. Is Maria’s manager an
agent of Royal Plumbing? If so, who may be liable for the
workplace problems? Do you have all the facts? If not, what
facts are required to make the determination of agency?
