Regulations have binding legal force inall Member States and enter into force on a predetermined date inall Member States. When a regulation comes into force, itoverrides all national laws dealing with the same subject matterand subsequent national legislation must be consistent with andmade in the light of the regulation. While member states areprohibited from obscuring the direct effect ofregulations, it is common practice to pass legislation dealing withconsequential matters arising from the coming into force of aregulation.For example: Food Information to ConsumersRegulation 1169/2011
Directives specify the outcomes that mustbe achieved, but each Member State is free to decide how toincorporate directives into national legislation. Directivesfirst have to be enacted into national law by member states beforetheir laws are ruling on individuals residing in theircountries. Directives normally leave member states with acertain amount of leeway as to the exact rules to be adopted.Directives can be adopted by means of a variety of legislativeprocedures depending on their subject matter. Forexample: Directive 2002/46 on the approximation of the laws of theMember States relating to food supplements
Decisions are EU laws that apply tospecific cases and are directed at one or more Member States,companies, or private individuals. They are legally binding onthose whom they are addressed. The legislative procedurefor the adoption of a decision varies depending on its subjectmatter. The ordinary legislative procedure requires theagreement of and allows amendments by both the EuropeanParliament and the Council of the European Union.The Assent procedure requires the agreement of bothParliament and Council, but the Parliament can only agree ordisagree to the text as a whole - it cannot propose amendments.The Consultation procedure requires the agreement of theCouncil alone, the Parliament merely being consulted on the text.In some areas, such as competition policy, the Commission mayitself issue decisions. For example: Commission ImplementingDecision 2016/1189 authorizing UV-treated milk as a novel food.
Recommendations are not legallyenforceable. A recommendation allows institutions to express theiropinions and propose a course of action without enforcing any legalobligations on those to which it is addressed. Recommendationsare without legal force but are negotiated and voted onaccording to the appropriate procedure. Recommendations differfrom regulations, directives and decisions, inthat they are not binding for Member States. Though without legalforce, they do have a political weight. The Recommendation is aninstrument of indirect action aiming at preparation of legislationin Member States, differing from the Directive only by the absenceof obligatory power. For example: Video conferencing to helpjudiciary to work better across borders.
