5. Based on the rules provided by Employment Act 1955, advise the relevant parties in the following scenarios: a. A manager in one company seeks your opinion about Adele, one of his employees. He told you that Adele just joined the company in January 2022 as Planning Executive. In early April 2022, Adele told him that she is pregnant with her first child and will be delivering sometime in October 2022. The manager wants to know whether the company has to give Adele paid maternity leave since she has not completed 12 months of service and her salary is RM3,800. Explain to the manager the position under Malaysian Employment Act 1955. (6 Marks) b. Harun is an administrative clerk earning a salary of RM1880 in Syarikat Wau Bulan. One Tuesday morning, he woke up feverish, dizzy, and nauseous. He suspected that he has the flu, so he asked his brother to purchase some medicines from a nearby pharmacy. After taking the medication, he went back to sleep and only reported back for work on Thursday. He was surprised when his employer wants to take disciplinary action against him for being absent. He claimed that he was sick and produced the receipt for the medicine that he bought as proof and maintain that he was not wrong for not coming to work on Tuesday and Wednesday as the Employment Act allows employees to take sick leave. Based on the given scenario, explain whether Harun's action is allowed under the Employment Act 1955. (7 Marks) (Total: 13 Marks)
