in Thomas v. St. Joseph
Healthcare (No. 2007-CA-001192MR, July 16, 2010).
The Court of Appeals concluded that, although the defendant
hospital did satisfy its EMTALA obligation to provide an
“appropriate medical screening” and the hospital thought it failed
to detect an emergency condition, the hospital nevertheless failed
to discharge its obligation to stabilize the patient’s
condition.
