Michelle and Juline are a common-law couple who have been
together for 4 years. They are raising Michelle's 7-year-old son
Jake which she had from her previous marriage to Mike. Mike and
Michelle divorced 5 years ago, and Michelle has sole custody of
Jake.
Juline is a successful dentist and owns a large home in Toronto, so
when they decided to move in together, Michelle gave up her
apartment and moved into Juline's house. They also decided that
Michelle would give up her role as a retail store manager to stay
home and home school Jake. Juline, your client, is in your office
for her annual review. While Juline and Michelle are happy together,
she asks you what would happen should they ever split up. Juline is
mostly concerned about the matrimonial home.
How do you respond?
a.
Tell Juline that the home would only be divided if it were
registered as JTWROS
b.
Advise Juline that the home would form part of the assets that
would be divided
c.
Advise Juline that she does not have to worry since the home is
registered in her name alone
d.
Let Juline know that since they are not legally married, the
matrimonial home would remain in Juline's possession
together for 4 years. They are raising Michelle's 7-year-old son
