This assignment is intended to get you familiar with how to find the law online. You may want to use the http://caselaw.findlaw.com/ web site, or the links to Oregon law provided under "Legal Research Sites" in the Web Links section of the Content page, or Google or other search engine to find the constitutions, statute(s) and case(s) that you are asked to examine for this assignment. You will also want to review the Assignment Rubrics before writing your paper so you will know what I am looking for when I grade your assignment; you can find the Rubrics in the "Introduction to this course" sub-module in the Week 1 Content page materials. Once you have found the materials (constitutions, statute[s] and case[s]) you can and should answer the questions without doing further research. The idea here is to learn critical thinking skills, not to conduct factual research online. Examine the materials and think about what you are looking at; don't search online for what someone else thinks about these issues. Then write up your answer - then edit and proofread it so that it is clear. The biggest source of lost points on this and the other assignments historically has been the failure to answer all the questions asked. Before submitting your work, double check to ensure you have answered all questions.
B. Statutes Find in the Oregon Revised Statutes (ORS) the specific statutes that deal with motorists who are stopped by the police for suspicion of driving under the influence of intoxicants. Can a motorist refuse to take field sobriety tests? If so, what are the consequences of such a refusal? Identify the statute by its number and title. Al-rev 170317 This section shouldn't take more than a paragraph or two. Be careful - this is trickier than it looks!
C. Court Cases Locate the Oregon Supreme Court case of In re Wollheim, which was submitted in January of 2008. What is that case about? Again, a couple of paragraphs here is plenty. Don't just summarize the case tell me what it is about. Again, be careful - this is not a gimmie! ch HIBER
