Jenny owns a property situated in a residential building. There
is a sitting room and a master room. There is a partition wall
between the two rooms. According to the Deed of Mutual Covenants of
the building, the partition wall is a load-bearing wall. The DMC
also assigns the exclusive use of the Wall to the owner to the
flat. Jenny is considering selling the flat. With a view to
negotiating for a higher selling price, Jenny has come up with the
idea of removing the Wall so as to make the Flat look bigger.
Explain to Jenny all issues involved in the problem scenario,
all legal actions that Jenny may need to face, all defence that are
available to Jenny.
