Which is a true statement about the doctrine of misrepresentation? One can never rescind a contract for misrepresentation if he did not rely on the false assertion of fact made by the other party. One's failure to volunteer information can never lead to rescission. A person who relies on a false assertion of fact can never rescind unless he conducted an independent investigation of the assertion before relying on it. Misrepresentation can never occur unless the person making the false assertion of fact knows that it is false and intends to decieve the person relying on the fact.
