statement. 1. The nurse and the oncologist The patient Michael is dying from pancreatic cancer at Metro Hospital where he is receiving chemotherapy. A registered nurse involved in his case, Nurse Lauren, learns that he has never received information about any alternative therapies. On her shift Nurse Lauren gives Michael the information and discusses the advantages and disadvantages of the various alternatives to his current treatment. After extensive reflection and consultation with his family, Michael decides to leave the hospital and begin to make arrangements to try one of the alternative therapies. He informs the attending oncologists of his decision. When the oncologist learns that Michael received information about the alternative therapies from Nurse Lauren, he writes her up with the hospital's administrators for unprofessional conduct. In the write up the oncologist requests that Nurse Lauren's nursing license be revoked or suspended for 2 years. After the write- up, Nurse Lauren argued to the hospital administrators that Michael had a right to know about the alternatives and that he should not have been receiving chemotherapy unless he had known about all of the options. (1) If it were the case that Michael would live 1 or 2 years longer with the chemotherapy than without the chemotherapy. Do you think that the oncologist was behaving negligently by not informing Michael about alternative therapies - Why or why not, explain you answer? (For comparison, the therapy that Michael has chosen will only help him to survive for about 6 or 8 months) (2) Based on the doctrine of "Respondeat Superior the doctor is liable for acts performed by my employees. Should the physician in charge have the final say about the information the patient receives, or do you feel that it is best for everyone on the care team to help keep the patient informed - explain your answer - (3) The language and wording of the write up issued by the oncologist is profoundly negative about the actions taken by nurse Lauren. Nurse Lauren believes that many of the claims written by the oncologist are false and that they will have an extremely negative effect on her professional reputation. Do you feel that Nurse Lauren has a legitimate case to sue the oncologist for defamation of character, if so what type of defamation - slander or libel. If she does not have a case please explain why. 5(4) The "reasonable person rule" clearly states that the physician must explain the diagnosis (what is the condition), prognosis (the state of his condition), the treatment plan, the alternatives to the treatment plan. Do you feel that the oncologist fulfilled all of these standards while Michael was under his care?
