How are decisions made by the panel of appeals court judges, and how may the actions of these judges affect the trial court judgment? 3. How is a civil legal action finally terminated, and what are the consequences of this final termination? 4. How important was the law in determining the outcome in the hypothetical Consumer case? Would "government standards" and "state of the art testing" exceptions have made a difference? 5. What are some of the most important issues in the area of civil litigation in the United States? 6. Is there really a litigation crisis that threatens to overwhelm our courts 7. What alternative dispute resolution (ADR) techniques are available to reduce the caseload of the overloaded courts? 8. Is there a liability crisis concerning the costs and benefits of the American tort system? 9. Should we use juries to decide questions of fact in dispute (especially monetary awards) in civil cases? 10. Should expert witnesses be designated by the court and the expenses billed to the losing party in the final judgment? 11. Should we develop a policy of awarding lawyer fees as part of the satisfaction of judgment required of losing parties in civil cases? 12. Should pain and suffering be eliminated from the damages that can be recovered in tort cases? 13. Do the practices in other countries suggest alternatives for court reform measures that might be introduced without drastically changing the character of our adversarial system?
