Is there really a litigation crisis that threatens to overwhelm our courts 7. What alternative dispute resolution (ADR) techniques are available to reduce the caseload of the overloaded courts? 8. Is there a liability crisis concerning the costs and benefits of the American tort system? 9. Should we use juries to decide questions of fact in dispute (especially monetary awards) in civil cases? 10. Should expert witnesses be designated by the court and the expenses billed to the losing party in the final judgment? 11. Should we develop a policy of awarding lawyer fees as part of the satisfaction of judgment required of losing parties in civil cases? 12.
